Research On Legal Management Capacity Assessment Of Heihe River Basin Based On Integrated Ecosystem Management

The Heihe river basin is the first largest inter-provincial and the second largest inland river in China,and has a comprehensive set of ecosystems.It stretches across alpine snow and ice tundra,a mountain forest belt,piedmont oases,and a desert belt.The midstream area has a long history of the agriculture and animal husbandry.The downstream area is the important national defense and milit ary base.Recently years,as the rapid development of social economy,the contradictions between supply and demand of basin water resources are sharpening.Assessment of management capabilities of legalizat ion can improve the legislat ive quality,legislat ive level and law enforcement capabilit ies,which is the rule and assurance of improving management system s.Assessment of river basin legis lat ion is necessary to keep a sustainable development of economy and sustainable management in Heihe river basin.At first,by coupling integrated ecosystem management and evaluat ion of law of resource and environment field,this research established a system of quantitative method to assess the management capabilit ies of legislat ion.We selected 14 laws and regulations which were closely related to the management of the Heihe river basin to unfold empirical research based on this method system.Expert interviews contributed to this selection.Finally,we proposed the current situation of the management capabilit ies of legislat ion and made suggestions.The results showed that(1)In capacity building of legislat ion and polic ies,it had formed mainly basin legalizat ion management system of the trinity(national legislat ion as a guide,local regulations to coordinate,special regulat ion to basin).However,(2)The capabilities of current system was weak and didn’t reach half of the ideal state.(3)The main problems included: The legislat ive conceptions were not matched well with the concept of REM;the level of regulations was low and the foundation of supervision and punishment was insufficient;management function of river basin management institution didn’t play fully;local regulations were not matched well with the unified management of river basin;there were some difficulties in management of water rights;a mechanism for ecological compensation was missing.(4)In order to consolidate the results of management,it’s urgent to strengthen the management of important water engineerings in the short term and enact a river basin law to assure an integrated management of Heihe river basin in the long term.Finally,this research puts forward a building program of “one large,one small,one medium” to promote the management capabilit ies of legislation of Heihe river basin.
