Study On Problems And Countermeasures Of Subjectival Responsibilities In Chongqing Construction Project Environmental Impact Assessment Process

Construction Project Environmental Impact Assessment(CPEIA),scientifically predicting adverse impact on humans' developing and producing activities,has played an important role in Chinese environmental management.However,in the prevailing Chinese Environmental Law and EIA Law,definitions on subjectival possible illegal acts in EIA are too general.This leads to some units' manipulations by picking and exploiting legal loopholes and CPEIA's accountability mechanism unclear.This paper focuses on all possible problems of each CPEIA subjects,deeply analyses factors affecting CPEIA effects,and proposes some advices to strengthen CPEIA effectiveness.The paper adopting the method of Expert Interview,interviews evaluation experts and employees from construction companies,CPEIA agencies,appraisal agencies,approval authorities and environmental monitoring agencies,to examine and collect all possible sujectival behavior problems in CPEIA.Based on the outcomes of Expert Interview,problems were consolidated,screened and finally applied to the questionnaire design,to investigate the status of subjectival behaviors in CPEIA process.This paper found that Main factors affecting the effect of CPEIA in Chongqing,include “Quality of EIA documents”,“Materials from the construction companies”,“Comparison of economic,social and environmental benefits”,“Background information from third-party agencies”,and “Review and management”.Among them,the most influential factors are “Quality of EIA documents” and “Materials from the construction companies”.The impact is mostly adverse:(1)Approving authority perform duties well;(2)phenomenon of blurry responsibility is existing;(3)some subjects fail to perform their responsibilities,which is centered on construction companies and EIA agencies,for instance,providing false construction information,computing discharge amount improperly,and without alternative plan.At last,we construct the supervision system of subjectival behaviors in CPEIA,with some management suggestions,including carrying out the list of subjectival responsibility in CPEIA;combing technical standards related to EIA;promoting the autonomy of EIA agencies;strengthening units' Quality Management System;encouraging focused review;strengthening the halfway and afterward supervision over development companies;building the public participation network platform of full lifecycle CPEIA.
