| With the rapid development of the economy,people’s living standards have been continuously improved.Gradually,people began to have a higher yearning for their living environment.We long for the blue sky,the crystal clear waters,and the aromatic and cool air.However,the current environmental problems caused by pollution have become more and more serious.We have begun to fully understand the extreme importance and urgency of accelerating the construction of an ecological civilization and earnestly enhance our sense of responsibility and mission.Firmly establishing respect for nature,conforming to nature,and protecting nature is not only a national policy decided by our Party Central Committee.It is also something that we in the hearts of the contemporary people are hoping for.Based on such a large background,in connection with some real-life environmental relief issues,this paper uses the literature analysis method,comparative analysis method,economic analysis method,and text analysis method to study the judicial remedy and existing problems in China.And put forward some of my own opinions on this.It is hoped that the study of judicial protection mechanisms can further arouse everyone’s attention to environmental issues and the improvement of judicial relief of our environmental interests.The environmental judicial relief mechanism should not merely be a relief to environmental rights and environmental rights.It should include greater relief of legal interests.We should not only confine ourselves to some of the environmental issues that are currently occurring.This is a question of environmental interests.It includes public and private rights.We should regard this as a major social issue and analyze our environmental justice remedy from a more comprehensive perspective.This article begins with the concept of environmental benefits,and elaborates on the concepts,types of environmental benefits and their relationships with environmental rights.As a new interest form,environmental interest is different from the general concept of legal concept of legal benefit.Environmental law should be based on environmental benefits rather than previous environmental or environmental rights.Under the new concept of environmental benefits,we begin to study and analyze our current status of environmental justice relief.Through the research and analysis of the current state of judicial remedy in our country’s current environment,we can find out the problem of environmental justice remedies that we now have.This is also the problem that we need to concentrate on the need to find and solve.With the introduction of the new environmental protection law,this article believes that there is still room for improvement in China’s environmental judicial remedies.The improvement of public welfarerelief and the supplement of private benefits are issues that we can continue to strive for in our current environmental justice remedy.At present,our environmental problems are frequent,air quality is getting lower and lower,perfecting the environmental judicial relief mechanism,and establishing a good ecological environment are the trend of the times.Environmental public welfare and environmental private interest are two kinds of judicial protection mechanisms for our protection of the environment.We should better cooperate with each other and improve each other.We strive to protect our environment in all aspects,so that everyone can protect their environmental interests.The author of this article firmly believes that adhering to green mountains and green mountains is Jinshan Yinshan.The improvement of the legal system can provide us with a better system guarantee.The members of the whole society are actively involved in action,so that the concept of ecological civilization construction deeply enters into everyone’s hearts.The modern and new pattern of people’s harmonious development with nature can drive fast in our country and really create a new one that belongs to our socialist ecological civilization. |
