Research On The Government’s Environmental Responsibility Under The Bachground Of Ecological Civilization System Reform

Environment is a kind of public product,which the profit and loss of the environment is closely related to the public interest.Environmental governance cannot set aside the government responsibility and the implementation.One of the important reasons for our environmental problems are not effectively solved is the vacancy of the Government’s environmental protection responsibility.Since the party’s 18,the CPC Central Committee,with general Secretary Xi Jinping as its core,has vigorously promoted the construction of ecological civilization and promoted the reform of ecological civilization.The content and performance of the Government’s duty for environmental protection are experiencing great changes.It is of great theoretical value and practical significance to study the duty of government environmental protection under the background of ecological civilization system reform and to put forward some suggestions on perfecting the government’s environmental responsibility.The government environmental protection responsibility can be understood from three aspects of morality,politics and law.This paper studies the responsibility of government environmental protection in the legal level.The responsibility of government environmental protection in the legal aspect,referring to the government is responsible for the environmental quality of the region,which includes these contents:the government implements the effective environmental law enforcement,and gives the timely and effective punishment to the illegal environment,the government implements the management to the unmanned area,the polluted area left by the history,the government provides minimum relief for environmental victims who are unable to compensate the persons responsible in the region.The theoretical basis of the government’s duty for environmental protection includes:public product,public entrustment,environmental rights and responsible government.The government environmental responsibility system of some countries outside the country has been inspected,such as the United States,Russia,Japan,and has drawn the inspiration for our country to study the responsibility of government environmental protection.China’s responsibility for environmental protection of the government has experienced from the 1979 Environmental Protection Law(trial),the 1989 Environmental Protection Act and the 2014 Revised Environmental Protection Act.The regulation of the government’s responsibility for environmental protection has experienced the trend from No to some,and the stipulation is more and more clear.However,there are still five major problems in the government’s environmental responsibility in China:the government’s duty for environmental protection is vague,the scope of the environmental governance is confused,the responsibility supervision is absent,the environmental performance evaluation mechanism is incomplete,and the mechanism of the investigation is weak.Also in this part,we do the research on the latest development arid evaluation of the government’s environmental responsibility since the party’s 18.China promotes the reform of ecological civilization system,vertical management reform of environmental protection,these latest developments make the government’s duty for environmental protection further clarified and better implemented.Under the background of the new era,we should improve the government’s environmental duty from the following aspects:standardizing the system of responsibility for environmental protection,perfecting the existing legislation of responsibility and strengthening the local legislation of environmental protection;promote the reform of the government’s environmental protection management system and implement the responsibility of local administrators.,strengthen the supervision over the implementation of the Government’s environmental responsibility,including establishing the national Environmental law enforcement inspectors system,perfecting the accountability of the government’s environmental responsibility,perfecting the information disclosure of the government environment and perfecting the environmental administrative public Interest litigation.In addition,it is necessary to optimize the government’s environmental protection responsibility system from the aspects of reforming the government’s environmental performance appraisal mechanism and establishing the scientific environment protection fund operation mechanism.
