The Reform Of Prospecting Rights Base On "Reforms To Delegate Power,Streamline Administration And Optimize Government Services" In China

Since 2002,affected by the influence of the rapid development of global economy,China's mining industry changes accordingly and the price of minerals is also rising,which making a large making a large number of resources invested into the mining market,such as human,technology,financial and other resources.To this end,the Ministry of Land and Resources has developed a lot of standards and restrictions to prevent the blind and wasteful development and utilization of mining resources.However,around 2012,with the continued depression of the global mining economy,mineral resources exploration marketgradually restored calm,that led a lot of money invest into real estate and other areas.Therefore,it is not suitable to use the previous ways of prospecting management,since they are unable to adapt to China's current mining form.This paper analyzes the existing management system of prospecting rights by means of literature research analysis,empirical analysis and mathematical simulation,and summarizes the relevant system of mineral resources exploration in typical countries,puts forward the existing problems in the existing system.Based on the Coase theorem,it also come up with the reform ideas and proposals of prospecting rightunder the existing legal system,which is "Decentralization,Combination with Laissez-faire and Management,OptimizationServices",and it provides the basis for the related reform of mineral resources exploration management system in China.The main conclusions of this paper are as follows:(1)We should adhere to the general idea of decentralization of the state,make full use of the "invisible" hand of the market,clarify the responsibilities of the administrative organs,reduce the administrative costs,simplify the administrative examination and approval matters,so as to stimulate the market vitality and improve the administrative efficiency.(2)At the same time,we need to protect the mining order,maintain the mineral resources rights and interests of our state as its owneridentity,and strengthen economic means to guarantee the progress of mineral resources exploration.(3)we also need to further improve the public information disclosure system and to establish the integrity of the mining enterprise system.Meanwhile,we can reduce administrative costs by internal management reform within the administrative departments,making a transition to a service-oriented government.
