| The rise of cultural pluralism opens up a new perspective our looks,there is no single culture in society and it’s particularly evident in the multi-ethnic integration of Chinese society.Guizhou Qingshui River area relatively closed,away from the central dynasty initially,with the development of Trees trading and Bureaucratization of native officer in Qing Dynasty,local residents began to integrate with the Han,accept Han culture and retain their own culture at the same time.Accept the imperialist governance while following the original rules and dispute resolution,Solve enormous disputes through contract.After long time conflict and reconciliation between culture from state and culture from local area,multicultural and pluralistic dispute resolution mechanism had formed in Guizhou Qingshui River area,Qing Dynasty.Minority people who lived in the middle and lower reaches of the Guizhou Qingshui River in the long-term forest transactions spontaneously had produced lots of contract and transaction process record files,which named “Qingshui River contract ”,recorded the local social conditions and customary law objectively.Among“Qingshui River contract”,there are a number of specific constructs which had recorded the disputes,the settlement process,the final result and been see as a certificate to prevent disputes happening again,has been called “the Justice contract”,including many types.The Justice contract objectively records the local long-term compliance rules,the authority and dispute Resolution,reflects the local social norms that do not use the national power to maintain neighborhood relations and social order at that time,shows relationship between the local social norms and rules of central authority.It can be said,Qingshui River contract continued,discoveries provides a material basis and object for the study of the local multi-dispute resolution mechanism.This paper mainly studies the historical pattern,characteristics and dispute resolution mechanism of the Justice Contract,explores the historical origin of its development and its modern significance. |
