With the market-oriented economic system reform, China labor relations is transforming from individual labor relations of strong political overtones, controlled by the administrative means, interests consistent type to the collective labor relations of economic interests based, regulated by the market mechanism, the interests of coordination type. In this process, the rights awareness, legal awareness, sense of solidarity and action of workers started to awake, and they request the share of economic development gradually. Then, the labor conflicts about the distribution of benefits and rights guaranteed outbreak in this era. The closing, merger and transfer of enterprises caused by industrial transformation and upgrading and the enhance of employee awareness of rights caused by the 2008 new Labor Contract Law exacerbate the outbreak of labor conflict furthers, it bring a greater impact on the social stability and economic development. In the special context of China's economic transformation,the exploring about the question that how will companies make the strategies choice to solve the different labor conflicts makes sense. On the one hand it can improve the labor relations theoretical framework, on the other hand it can help enterprises to understande labor conflicts to choose right strategy.The study method of this paper is the Grounded Theory of Strauss and Corbin,and it chooses the eight information richest companies as the case. From the interview data, the study get 324 tags and 138 concepts, and then refined into "91 category, 6main categories and a core category". After careful studing,This article describes the employer labor conflict resolution procedure as nature of the conflict- consequences forecast- the situation factors of internal and external- strategy selection structure.The dimension of the conflict nature is the comprehensive standards to identify labor conflicts event, the consequences forecast is a set of behaviors for discriminating and contrasting the different strategies, the situation factors of internal and external covers most factors that influences the strategy choice, the strategy selection is a reasonable induction of solution. In particular:Firstly, corporate behavior Compliance, the demands of species, employee bargaining power, conflict types, and the imitability can affect the result of strategy selection.Secondly, the enterprise take strategy lists- cost, loss, risk measurement –comparative analysis as the method of strategy section.Thirdly, the internal situation factors contain tendency, business situation, values and experience,the external situation factors contain labor market conditions,geographic policy, industry characteristics and legal background.Fourthly, in corporate interests emphasis and employees interests emphasis standard, the labor conflict solve strategy is divided into obedience, compromise,fighting and ignoring.
