Research On The Legal Issues Of The Housing Reverse Mortgage System In China

The social security situation of the elderly in our country is not optimistic.The pressure of the family and the government is increasing year by year.It is an effective direction for the current situation to establish a reasonable and feasible operation mode of the commercial pension insurance by using the market economy.But at present,the practical effect of exploring housing reverse mortgage is not ideal,and the relevant legal system has not adapted to the pilot's promotion,and there are many shortcomings.Moreover,this deficiency has become the weakness of the development of housing reverse mortgage.Therefore,it is proper to study the effective implementation of reverse mortgage system from the perspective of solving legal problems.The thesis begins with the explanation of the basic theory of reverse mortgage for housing.By clarifying the connotation and legal relationship of reverse mortgage,the basic concepts of housing reverse mortgage system and the necessity of promoting the system are determined.Through reviewing the current status of our housing counter-mortgage pilots and the experience of developed countries outside the region,the legal issues that existed in the emerging stage mainly focused on conflicts between the housing reverse mortgage system and the property rights legal system,the housing reverse mortgage system and related legal systems.There is a mismatch between them.It is suggested to improve the legal system of property rights as a starting point,gradually solve the problem of automatic renewal of the right to use the residential land and establish a risk management for insurance institutions,so as to improve the legal system of reverse mortgage in housing in China.
