Research On Legal Issues Of PPP Projects In Public Hospitals In China

With the development of economy,the aging speed is accelerated and the demand for medicine and health service is growing rapidly.However,public hospitals have long been dominant in China's medicine and health field.The lack of medical resources and structural imbalance lead to the aggravation of medical treatment and expensive medical treatment.PPP(public-private-partnership)refers to the public sector and private sector setting up a long-term partnership to provide public service.Within the framework,both sides take full advantages and share the risks and benefits.PPP,as a mature reform and development mode in foreign medical field and domestic infrastructure construction,has gradually been applied to China's medical and health field.Meanwhile,it is undoubtedly conductive to providing more and better health care services and good for reducing government financial pressure and promoting public hospital reform.However,health PPP projects in China starts late,develops fast and lacks professional talent.At the same time,with the immature legal environment and system about PPP in our country,many problems arise about the practice of PPP in medical and health field.The study,based on the theory in the public service and the realistic foundation of public reform in China,takes the hospital PPP project in our country as the research object and combs urgency and key legal problems in the public hospital PPP projects in China.In order to explore the fine legal environment for the development of PPP projects in public hospitals in China,this paper proposes corresponding solutions based on the reference of foreign PPP legislation.
