In the field of criminal justice in China,the system of criminal legal aid has not been paid enough attention.The reason is too much focuses are on the investigation system,the prosecution system and judicial system,so it often neglects the criminal defense,the lawyer system in the important position of the whole criminal lawsuit pattern,and criminal legal aid system for promoting the application of the criminal defense,the lawyer system effect plays a unique role.This paper takes two cases as the breakthrough point and discusses the problems existing in the application of the criminal legal aid system,which involves the scope of criminal legal aid,the procedure,the mode of aid,etc.On the basis of understanding the concept and function of the criminal legal aid system,some perfect views and suggestions are put forward.In order to improve the system of criminal legal aid,it is necessary to provide assistance first.Therefore,it is necessary to expand the scope of assistance in the long run to achieve full coverage of legal aid;Secondly,we should achieve the ultimate aim by improving the actual effect of the defense after legal aid;Finally,there will be a series of safeguards to consolidate the system.Under the new historical opportunity,we hope that the system of criminal legal aid can be revitalized and realize the common development of theory and practice.
