On The Identification Of The Joint Debt Of Husband And Wife

With the rapid development of our country’s economy,more and more people are involved in economic activities and trading activities become more and more frequent.Due to changes in consumers’ attitudes,it is common for people to consume out of debts.These are reflected in the family,and the phenomenon of mutual liabilities of husband and wife is also more and more common,which tends to develop and change complicatedly and diversely.In recent years,with the change of people’s concept of marriage,the rate of divorce in our country has been rising steadily.According to the relevant regulations of our country’s law,the common debt of husband and wife must be dealt with in the case of confirmation of divorce.The debt problem of husband and wife is not only closely related to both husband and wife,but also closely linked with the interests of the third party.Therefore,it is of great significance to accurately identify the common debt of husband and wife.However,the rules about the common debt of husband and wife in the legislation of our country are scattered and there is no unified concept and standard.In practice,due to the interest relationship,some couples get so-called divorce in order to avoid debt.While some other couples are in fictitious debts with others in order to obtain more property in divorce,which makes it more difficult for the judges to handle cases involving the common debt of husband and wife.In this paper,I mainly analyze and research the common debt problem of husband and wife when handling such problems with my own experiences,as well as concluding some methods to deal with this problem.Finally,I will learn from the experience and deeds of my colleagues and refer and study from the opinions of some related scholars,so as to come up with some perfected measures on identification issues of mutual liabilities of husband and wife.
