On March 15,2017,the Fifth Session of the Twelfth National People’s Congress passed the "General Principles of the Civil Law of the People’s Republic of China".The provisions of Articles 115 and 127 of the “General Principles of Civil Law” fill the gaps in the protection of cyber virtual assets by Chinese law,and go beyond the first step in the protection of virtual assets.Prior to the adoption of the “General Principles of Civil Law”,the law of our country did not provide for the concept and attributes of cyber virtual property,which led public security agencies to adopt the practice of not filing a case for online game equipment.Now it seems that this losting practice not only harms the legitimate rights and interests of netizen but also not conducive to the harmonious development of society.However,the provisions of Article 127 of the "General Principles of Civil Law" are general and prescriptive and not be directly used as a basis for solving the problems of network virtual property inheritance.Therefore,on the basis of analyzing the characteristics of our country’s network virtual property,network ownership and our country’s network virtual property inheritance,combined with China’s national conditions,and the experience of foreign countries’ legal inheritance of network virtual property,we propose a solution to our country’s network problems an specific advice on virtual property inheritance.
