Legal Thinking About The Problem Of Drug Driving

Although the problem of drug driving has existed for many years,but in recent years,it is because of growing,and an endless stream of drug driving accident caused public attention to the extreme cases.China’s current legal system has not been clear on the definition of legal measures for drug driving,drug driving problems only in the "driving behavior of road traffic safety law" prohibited drugs,by modifying the "Regulations" to apply for a driving license and use,providing a legal basis for the cancellation of drug driving personnel vehicle driving license.Drug driving behavior,although there is a huge social risk is the lack of legal provisions of the provisions,the relative lag of the legal system is not compatible with the criminal responsibility,can not play a good control effect.After the drunk driving into the penalty and achieved good results,the current call for drug driving into the penalty is increasing,but there are few domestic related basic research on drug driving behavior,which restricted our view of the legislative process of drug driving.In this paper,the current domestic and foreign drug driving situation and drug driving legislation were reviewed,and then pointed out that China’s existing legal system on the problem of the problem and deficiency.Through the investigation and Study on the multi dimensions of the drug addicts in the compulsory isolation detoxification center of Qingdao,Including Minnesota multiphase personality inventory(MMPI),drug use before and after drug use,Barrett personality questionnaire,impulsive driving conditions and other aspects of the investigation of multi dimension sample survey,tries to harm the first hand data to demonstrate drug driving behavior,and to our country poison driving the legislation of zero tolerance and progressive penalty system of two specific recommendations,in order to provide legal design for drug driving problem of reference.
