On How Public Security Organs Can Promote The Reform Of Litigation System Centered On Trial

The decision of the Central Committee of the Communist Party of China on the major issues concerning the overall promotion of the rule of law according to the law of the people's Republic of China(hereinafter referred to as the decision)adopted in the fourth Plenary Session of the 18 th CPC Central Committee: To promote the reform of the reform of the litigation system as the center of the trial,to ensure that the facts of the investigation,prosecution and prosecution of facts can stand the test of law." This decision puts forward higher requirements for the investigation activities of the public security organs.In view of the reform of the judicial system,how should the public security organs respond and how to implement them? Based on the experience of the public security work,the author discusses the background and understanding of the reform of the litigation system centered on the trial,Taking Beijing Public Security Bureau as an example,how to face the difficulties and problems in the reform of public security organs,How to better promote the reform of the trial centered system of litigation,and provide some suggestions to better implement the requirements of the decision.The first part illustrates the connotation of the trial centered litigation system reform,one is based on the views of scholars in order to clear the trial as the center and the meaning of the existence of errors,the two is proposed to trial as the center of the litigation system reform background,three is to promote the trial centered litigation system significance.The second part combined with the public security work,analysis of the impact of the trial centered litigation system reform of public security work,respectively,from the traditional "Investigation Centered" concept,the investigation work requirements,the public security organs "substantive justice" and "confession verdict" view and handling public security organs handling the overall quality of the police four aspects.The third part emphasizes the status and difficulties of the public security organs to deal with the "trial centered" litigation system reform,including is to detect as the center of the concept of thinking does not change,the two is the confession centralism prone to miscarriages of justice occurred,three is centered on the trial supporting system is not perfect,four cases within the system law enforcement is not reasonable.The fourth part is combined with the Beijing Municipal Public Security Bureau of investigation and the reform of the integration of my working experience,and puts forward some concrete measures for the publicsecurity organs to deal with "trial centered" litigation system reform,including perfecting legislation and establish perfect adaptation litigation system reform investigation system,raise the ability to promote the legal protection,strengthen the responsibility of forensic evidence to complete to strengthen communication,promote the construction of a comprehensive collection of evidence,litigation supervision mechanism model.The reform of litigation system centered on trial is a systematic project,and many problems will be encountered in the course of advancing.This article embarks from the individual only in actual work situation,for a small part of the problem is expounded and their opinions,expectations of the public security organs to promote the trial centered litigation system reform to promote.
