The mutual trust between the laborer and the employee is the basis for maintaining harmonious relationship. From the perspective of the laborer,fulfill the duty of loyalty is the key to gain the trust of the employee. Laborers’ duty of loyalty is the general term that laborers have to fulfill the obligations such as obeying,informing, keeping trade secrets and non-competition which based on the principle of good faith and the constancy and dependency of labor relationship for the legal interests of employees. Laborers’ duty of loyalty is part of collateral obligation of laborers with the characteristics of ethic and sociological jurisprudence. Laborers have their own independent personality and they are entitled to pursue their legitimate rights under the background of modern labor relations. Therefore, the legal boundary of laborers’ duty of loyalty can’t be expanded into infinity. Different levers of laborers’ identities,behavior after work and laborers’ great interests as well as public interests should be taken into considerations when establishing the legal boundary of laborers’ duty of loyalty so that the duty of loyalty plays an active role in safeguarding employees’ and laborers’ legal interests. Considering the situation that the employees are much more stronger than the laborers,it is suitable to limit the principle of contract and choose the principle of liability for faults when laborers hold responsibility who violating duty of loyalty. Laborers have to take the punishment and undertake the corresponding compensational liability when breaching the duty of loyalty. Because of laborers’ weak position and the legislative purpose of giving more legal protection to weak side in labor relation, more attention has been paid to the laborers’ rights which is responsible for laborers’ obligation is make inadequate regulations on this issue in labor law. It is important to perfect the institution by putting forward proposal from three aspects which involves the basic contents,considerations as well as the legal consequences. |
