| From a historical point of view, labor union arises from the need to protect the rights and interests of laborers. China’s relevant laws also clearly stipulate that the main responsibility of labor union is rights. However, in the real world for a variety of reasons,the labor union is not a good protection of the rights and interests of workers.Labor unions are embarrassing. Especially since our country enters the new normal economic development, macroeconomic growth slowed down, substantial economic benefits decline, the contradiction of labor relations enters into the prominent period and the multiple period. Labor unions face high demands of workers and the rights of the party and the government, the expectation of the community, in the protection of workers and employees began a series of reform and exploration, for some of the hot news of labor relations frequently repeated accusations. This paper seeks to discuss the following problems: why labor unions are difficult to do? How does the labor union rights function enhance?The paper first reviews the history of Chinese labor unions since 1949, compares and analyzes the three kinds of local labor unions’ right-safeguarding mode in Yiwu,Xinyang and Kunshan. This article take the new Public Service theory and Corporations Perspective, the labor union of L district in Nanjing city as the example to analyze the basic situation and existing problems, such as the imperfection of the labor union rights system, the lack of representation of the labor unions, the poor channel of labor union rights and the lag f labor union construction, and provide the empirical basis for strengthening the functions of labor union rights. On the basis of the above, the author analyzes the causes of the plight of labor union rights from five aspects: restricted environment, high rights demands, imbalance rights management process, inefficient rights protection mechanism and lack of rights management experience.Through the discussion of the problems and causes of the rights and interests of contemporary Chinese labor unions, this paper tries to find out the implementation path of strengthening the functions of rights protection. This paper thinks that we should strengthen the rights of labor union from 5 aspects, such as do a good job of top-level design, improve labor union rights protection system, enhance awareness of rights, enhance workers’ rights, rebuild workers’ trust, reshape labor union representation,expand rights path,innovate labor union rights protection mechanism,promote reform and innovation, strengthen labor union construction. Only through these ways, can the labor union play a good role in representing and safeguarding the rights and interests of workers, promoting the decent work of workers and building a harmonious labor relationship, and better demonstrate the value of labor union. |
