Research On Local Civil Justice Reform

On November 12th 2013, the central government adopted Decision of the Central Committee of the Communist Party of China on Some Major Issues Concerning Comprehensively Deepening the Reform on the 3rd Plenary Session of 18th CPC Central Committee, with the judicial reform as one of the important tasks. On October 23rd 2014, the central government further adopted Decision of the Central Committee of the Communist Party of China on Some Major Issues Concerning Comprehensively Implementing Governing the Country According to the Law on the 4th Plenary Session of 18th CPC Central Committee, which pointed out that the general target is to form a system serving "the socialist rule of law with Chinese characteristics" and build a country under "the socialist rule of law", and the central government showed the concrete measures clearly on how to promote the judicial reform. The judicial reform has lasted for several years in China, which will contribute to the fulfillment of governing the country according to the law and enhance the building of a law-based country. Histories show us that there were judicial reforms conducted by different local governments respectively in every judicial reform. Of these local reform practices, some were successful and provided good examples for the nation-wide reform,some were failed,and didn't get the expected results.Currently, the judicial reform needs to be in accordance with the reform principle"from top to bottom", which is deployed by the central government. This kind of judicial reform is prioritized and leading in the whole country. Meanwhile, it should emphasize the guidance from the central government. The judicial reform under the central government should be piloted firstly, and then promoted by the central government systematically and progressively. Usually, the local judicial reform is carried out after the implement of national judicial reform, and the local judicial authorities should explore and make efforts to solve practical problems prior to the national judicial reform.This paper will analyze the concepts, characteristics, current situations and significances of local civil judicial reform from the perspective of local civil judicial reform. In this paper, Chapter ? will focus on the analysis of related concepts,characteristics and current situations. In Chapter ?, the author will introduce some successful examples about the local civil judicial reform. And in Chapter ?,the author will introduce some failed examples about the local civil judicial reform.Finally in Chapter ?, the author will compare and analyze the examples in Chapter ?and Chapter ?,and will summarize current problems and trend of local civil judicial reform.
