Along with our country population aging advancement even more obvious, pension has become a hot topic of the entire society. In 2017, the "national twice conventions" also reiterated the importance of the pension system. In recent years, the domestic "means of pension","home-based pension", "reverse mortgage" and other social new supporting models for the aged has emerged, and constantly exploring the old way to solve the pension problem, reverse mortgage is one of them.Reverse mortgage,also known as "reverse fault". It is a new type of pension financing tools,mainly for the elderly, who lack of money. It is to solve the pressure on China’s old-age security system to improve the living standards of the elderly. It is great significance to o cultivate a more healthy way of life. Reverse mortgage is a new way for China’s social pension system,that for the reform and improvement of the provision.Since 2013, Xiaosu Meng proposed for the first time since the establishment of reverse mortgage life insurance services. In June 23, 2014, China Insurance Regulatory Commission issued a guide to the formal start of the housing reverse mortgage pension insurance pilot work. In July 2016, China Insurance Regulatory Commission once again issued a notice, which extended the elderly housing reverse mortgage pension insurance pilot period to June 30, 2018, and expanded the pilot city to further the scope. Although the housing reverse mortgage in China is still in the pilot phase, but many legal issues have been highlighted.This paper aims to study the legal problems of the implementation of reverse mortgage in China. The article mainly starts from four parts. The first part of the article begins with the overview of housing reverse mortgage, and introduces its concept, legal characteristics, foreign development model and comparison with related concepts. The second part of the article combines the practice of our country, the reverse mortgage mode. The third part of the article, focusing on the analysis of China’s development of the model of the existence of legal issues, including legislative and policy obstacles. Finally, the fourth part of the article, for the implementation of China’s reverse mortgage for the existing problems, put forward the correspondings solution.
