Analysis On The Legal Issues Of The Protection Of Small And Medium Investors' Rights And Interests In China's Securities Market

In any a relatively perfect stock market,medium and small investors are the fundamental participants and the cornerstone of the stock market to survive.Thus,a protection of them is of great significance in themselves,protecting the stock market and promoting the healthy development of the national economy.In recent years,the protection of the rights and interests of medium and small investors has made many important achievements in the stock market in China.But due to the defects in our law system,there are still problems like insider dealing,market control,explosion of false information,inefficient monitoring and punishment and irredeemable legal system,causing frequent unlawful infringement of the investors’ benefits.This paper tries to analyze the investors’ right protection,existing problems and reasons of infringement,hoping to promote the improvement of the legal system and the development of the stock market of China.This paper consists of the following four parts.In the first part,the research background and current situation of the protection of investors’ rights in China’s stock market are sorted out,so as to lay a good foundation for subsequent research.In the second part of the paper,protection of the medium and small investors’rights,existing problems and possible causes are mentioned on the basis of the development of China’s stock market.In the third part,the author compares the legal systems both at home and abroad concerning the protection of the medium and small investors’ rights,especially those in the United States,Britain,Germany,bringing about some significant learning procedures.In the fourth part,on the basis of comparison of domestic and foreign mature experience mature,coming up with suggestions for the completion of the right protection system.
