| With the sustained and rapid development of economy in China,people’s living standard has improved greatly.Like motor vehicle,this kind of vehicle has gradually become the necessities in people’s daily life.We benefit from the convenience that it brings to us,at the same time,we have to stand the negative effects,which are harmful to the atmospheric environment---the emission pollution of the emission source of mobile air pollutant.In recent years,haze and other air pollution problems happened frequently,which has a serious impact on people’s life and production.How to reply to the problem of the emission source of mobile air pollutant effectively arises public common concern.There is no doubt that the improving legal system is essential to deal with the pollution problem of mobile source.The construction and perfection of management system is system engineering for the emission source of mobile air pollutant.It not only needs advanced technical conditions as support,but also the supervision of government and environment protection department and the active participation of general public.In China,e.g.Environmental Protection Act,Atmospheric Pollution Prevention Law,Road Traffic Safety Law,these relevant laws formulate some rules for the control and management of the emission source of the mobile air pollutant,which has been preliminarily formed the prototype of the legal system.But when it refers to the establishment of the specific management system,the unity of the strict emission regulations and the strength of the related matching safeguard measures,there are still many problems and shortages existing in some aspects.What is more,these rules are far from the rules that are formulated in The Clean Air Act in the U.S.They are reasonable,careful,scientific,advanced and practical.We need to explore and improve constantly.The Clean Air Act is hailed as the most strict air laws in history.It has more comprehensive and systematic rules on the management system of the emission source of the mobile air pollutant.This article attempts to introduce and analyze the management system of the emission source of the mobile air pollutant and then explore the new featuresand thoughts for the control of legal management,which is related to the emission source of the mobile air pollutant.Besides,try to put forward some improving suggestions to our management system of the emission source of the mobile air pollutant,sequentially to make contributions to the development of research and practice of the emission source of the mobile air pollutant.This article includes six parts.The first part is introduction,which introduce the reasons and meanings of the research project and the present research status both domestic and abroad.The second part is summary,which is related to the management system of the emission source of the U.S.mobile air pollutant.Including conception,classification and features of the emission source of the mobile air pollutant and analyzing the development history on management system of the emission source of the U.S.mobile air pollutant.The third part is to introduce specifically the emission standard which American aim at setting up the emission source of the mobile air pollutant.The forth part is about the safe guard measures of the emission source of the mobile air pollutant.The fifth part is to analyze the present status and major problems of the management system,which refers to the emission source of the mobile air pollutant.The last part is to give some advices for improving our management system of the emission source of the mobile air pollutant. |
