Research On Large-scale Infringement Issues Caused By Vaccination

The mass torts caused by vaccination has resulted in persistent and serious personal injuries and property damages to inoculated people,therefore,the relief shall be provided for the victim.After analyzing the conception and characteristic of the mass tort,it was discovered that instead of being a new-type special tort,the mass torts behavior can be effectively analyzed by “Tort Liability Law”.It is of significant importance to the mass-torts confirmation and undertaking of responsibility that the legal relation,causality and liability-fixation doctrine of mass tort caused by vaccination are analyzed on the basis of several vaccine incidents happened in recent years.On the ground of the deficiency to effectively providing relief for victims by existing civil tort action and prevention and relief mechanism for abnormal action of vaccinating,the thesis puts forward that the introduction of vaccine damage relief fund could contribute to the perfection of vaccine damage relief system so as to better handle the mass tort caused by vaccination.
