The Effective Exercise Of The Rights Of Cooperative Members

The problems concerning agriculture,rural areas and farmers are concentrated on the issue of peasants’rights.The weakness of the peasants’ rights will not necessarily make the peasants develop into a specific equal subject.In order to change this scattered and weak position,we must seek unity,seek the support of organizations,and move from individual to joint.As a cooperative society in a broad rural society,the principle of joint ownership and democratic management has a natural connection with farmers and can become an important market subject and organizational support for solving the "three rural issues".The healthy development of cooperatives needs to be based on the effective exercise and comprehensive protection of its members and members’ rights."No relief,no right",the realization of the right of the members of the cooperative society requires not only the explicit provisions of the law,but more importantly,the construction of a relatively complete right relief system.It should be noted that China has experienced a long period of feudal times,the personality has been suppressed for a long time,so the traditional historical and cultural traditions lack the concept and soil of exercising the right of membership.In the tide of socialist construction,the construction of democracy and the rule of law in China is paid more and more attention to people’s privacy,and attracts more and more attention,as a member of the rights of vulnerable groups will get attention and protection of the law.Based on this,the author believes that to protect the effective exercise of the right of membership,we must focus on the disadvantaged position of the member,and properly protect the membership right of the member.This paper is divided into four parts to study the exercise and relief of the right of cooperative members:The first part is the derivation of the problem.It explains whether the right of membership can be exercised effectively and how to effectively exercise the membership right from the independent point of view.The second part introduces the legal analysis of the effective exercise of the right of the member.Firstly,in the aspect of internal analysis of the weakness of the cooperative itself to exercise their rights,and in the objective aspect,in the analysis of cooperative interests and the interests of cooperatives and other subjects based on the differences,summarizes the status quo of democratic control of the grammaticalization of cooperatives.Finally,from the analysis of the obstacles of the members exercising their rights independently,the author concludes the complex nature of the economic,non economic,relativity and absoluteness,procedural and substantiality of the membership right of the cooperatives.The third part discusses the choice of the effective exercise of the right of cooperatives.Through analyzing the present situation characteristic analysis of cooperative compound and its membership rights trading capacity weak above summary,in this paper,the concept of protection realizes the transformation from the abstract to the equal protection of the tilt protection,right through the representative system of agency system,agency staff members the right to set up and perfect the cooperative power separation exercise in the exercise way on.The fourth part focuses on how to realize the effective relief of the right of cooperative members in law.In this paper,through the main countries and regions,as well as the status quo of China’s legal remedies for the rights of members,from private relief,administrative law enforcement relief and judicial relief,etc..
