Research On The Rule Of Law In Administrative Investigation In China

Administrative investigation of our country under the rule of law development complied with the trend of the administrative law.Administrative investigation of our country under the rule of law can not only make up for a lack of related legal system of norms and procedures,improve the administrative subject consciousness of the rule of law,but also can effectively curb administrative investigation power abuse,enhance the legitimacy of the administrative investigation,and to fundamentally protect the legal rights and interests of administrative relative person.Here with the basic theory of administrative investigation as a starting point,from the perspective of the rule of law to clarify the connotation of the administrative investigation under the rule of law,at the same time,in-depth analysis of the necessity of administrative investigation of our country under the rule of law and its theoretical basis.Then the investigation and analysis of the status quo of administrative investigation of our country under the rule of law,and analyses the practical problems and the cause of the administrative investigation in China.Finally on this basis,combining with the experience of the rule of law outside the administrative investigation,put forward from two aspects of legislation basis and legislation mode of the administrative investigation of unified legislation thinking.And,on the analysis of the principle of administrative investigation,application and related system,fully integrate the concept of the rule of law,in order to contribute to promoting the construction of administrative investigation of our country under the rule of law.
