On The Improvement Of The Civil Execution Participation Distribution System

In recent years,the serious problem of "difficult enforcement "of China greatly influences the security of transactions and the level of social credibility.This has to do very much with the imperfection for our in the civil execution.In the paper,the origin and institutional evolution are combed and summarized for our current system of participation in distribution in the civil execution.It is argued that many judicial interpretations that Supreme Court comed to orient the participation in distribution will be gradually improved.However,there are many loopholes and deficiencies.In this paper,the analysis of its operation machanism have contributed to find a breakthrough and focus to improve the system.Also,the investigation of its operation practice and relative countermeasures will probably deal with some practical problems such as "difficult enforcement ","unjust enforcement "and so on.This paper consists of three parts except preface and epilogue.First,the article provides a brief introduction to the origin of the system of participation in distribution and gives a comprehensive overview about its system evolution. The emphasis is on the analysis of four judicial interpretations that Supreme Court has issued since 1992.And this part focuses on its reforms content and evolvement logic.Thus a summary,for the execution of the system of participation in distribution,is described.Secondly,this part analyzed current problems of the system.These problems include:value position is unreasonable;under the conditions of the system distribution,recognized standard of maturing debt is not unified;its deadline is indistinct; the notification procedure is insufficient and procedural link of this system exists problems.Finally,to make recommendations how to improve the system of participation in distribution in the civil execution.It is mainly the establishment of multiple value goals,the reasonable conditions of definiting and the restoring order of procedure connection in our executive system of participation in distribution.
