Preferential transfer is an important system of bankruptcy law, it is used to make sure that all the creditors can acquire their right under the equitable principle, and it also protect the interests of creditors. Firstly, this paper analyzed the definition and features of preferential transfer and its elements, clarified its definition and also clarified the difference between it and fraud on bankruptcy. Secondly, this paper by comparing the general behavior of revocation with the special behavior of revocation to explain its legal consequences.Thirdly, this paper analyzed the differences between the domestic preferential transfer and the international preferential transfer, to further strengthen the awareness and understanding about preferential transfer. to learn advanced foreign legislative experience, pointed out the status quo in China. Finally, this paper clarified issues arising in the legislation and practice of preferential transfer, combined with the foregoing content, and referenced the international legislation about preferential transfer, in order to put forward settlements which can repair the disadvantages of legislation, and establish a more reasonable preferential transfer system which meets the requirement of real life and promote its development in our bankruptcy practice, meet the needs of our bankruptcy practice.
