The fundamental purpose of the establishment of nature reserves is to protect the natural environment from being damaged.As social public goods,the public welfare is considered.As the stakeholders in the nature reserves,the development of original i nhabitants’ own interests is put in the first place under the empowerment of traditional natural rights.The conflict of different targets makes it more and more difficult to ad apt to the change of natural reserves from the regional public goods to the public good s in the whole society.In order to coordinate and resolve these conflicts,this paper ar gues that it is necessary to start from the source.The understanding of the rights and O bligations of the original inhabitants in the nature reserves is not in place and is relati vely uncertain,especially the property right system is not clear and management mode is not perfect in nature reserves.In these circumstances,it is very important to clarify the property rights ystem of nature reserves and determine the rationality of communit y condominium in nature reserves so as to further construct the rights and obligations of original inhabitants in nature reserves and ensure the fulfillment of their rights and obligations.In order to realize the coordinated development of the nature reserves and the ori ginal inhabitants,we should not only pay attention to the ecological value of the natur e reserves but also to the economic interests of the native people.The basic principle i s to determine the legitimacy of the rights between the nature reserves and the native p eople.As one of the management modes of nature reserves,community co-manageme nt plays an important role in coordinating the conflicts and balanced development.Thi s paper explores the rights and obligations of the native people under the community c o-management model starting from the perspective of the nature reserves and the com munity condominium ownership structure.It also protects the rights of the native peop le through community’s empowerment to them so that we can solve the contradictio n in nature reserves completely. |
