The Extension Model And Solution Of Patent Conflict In Industrial Technology Standard Alliance

Industrial technology standard alliance is an important carrier, occupying an important mission to be standing out in national industry competition. Under the background of patent and technical standard merging together, patents have drawn more and more attention between alliance members. Complex relations network, incomplete contract and other reasons make a large number of conflicts and contradictions during operation. Conflicts may occur between members, it will also impede alliance run normally, and most conflicts occurred around patent. Conflicts hinder the process of industrial technical standardization. Now, the researches aiming at solving patent conflicts are rare.In this paper, we combine domestic and foreign related literature with the union concrete cases, summarized five types of patent activity and four types of patent conflict, and proposed a patent conflict management framework. Using extension method, established extension model and extension set, generated solving strategies by extension analysis and extension transformation, then came up with some policy strategies. In the empirical research, conflict classification has been proved effectiveness through listing patent conflicts in TD communication industry association. Establishing extension model of two typical patent conflicts, generate strategies by extension transformation.This research provides theoretical reference and method support, in favour of the success of industrial technical standardization alliance.
