In recent years,labor disputes are increasing daily.Among them,cases about the employers firing the employee because of their seriously violating rules and regulations are also more and more.At present,our country lack of detailed and specific rules about a serious violation of rules and regulations.In judicial practice,all the cases are committed to the judiciary discretion.Which judicial officers have different legal professional,cognition and so on causes the different decisions.It seriously damages the judicial authority.As a result,the text makes the case as a turning point to expand on a topic of dismissing for the serious violation of employer’s rules and regulations.Beginning with the concept,the character,the content of employer’s rules and regulations,the text introduces present Chinese laws and administrative regulations about seriously violating employer’s rules and regulations,including laws and administrative regulations,normative documents made by the local state organs,laws on remediation,introduces and analyzes legislation and judicatory practice about the serious violation of employer’s rules and regulations in France,Germany and Taiwan.Based on it,the text analyzes the insufficient legislation about employee’s serious violation of company’s rules and regulations in our country,proposes advice on legislation,and proposes measures for employers.
