Study On The Investigation And Verification System Of Administrative Authorities On Identification Of Industrial Injuries

Industrial injury is a result of the rapid development of the social economy. The identification results made by social insurance administrative departments are not only related to the vital interests of both sides of the labor, but also related to social stability and development. The bureau of Human Resources and social security is the administrative department of social insurance, and industrial injuries identification has been the main cases of defendant conducted by the department with gradual rise. For this kind of cases, the administration, as the defendant, shall bear the main burden of proof. The judicial support mainly lies in whether the administration has performed the due diligence to carry out investigation and obtain evidence in the process of industrial injuries identification.Therefore, this paper adopts empirical research method, following from the industrial injuries identification conducted by the District Bureau of human resources and social security, based on the actual data and cases, focusing on investigation and verification of administrative authorities, analyzes problems on legislation and actual practice, and then puts forward suggestions to improve investigation and verification system of administrative authorities about work-related injuries identification.
