Research On The Reform Of The Civil Execution System In The Era Of The Internet

The civil execution system is an important part of the civil litigation system and the last part of the whole civil procedure,whose task is to carry out the effective ruling made by the people's court and re-regulate the civil rights and obligations in dispute.In the context of the Internet,the civil execution system is faced with many problems,including the traditional problems about " Hard to Execute" and series of new problems which results from profound changes in many fields brought by the popularity of the network.In this environment,the efficiency of civil execution,the implementation of the results and the implementation of efficiency have been affected and there are more new problems need to solve urgently.This paper mainly analyzes and summarizes the problems caused by the civil execution system in the network environment,dugs into the profound reasons behind the problems.At the same time,it summarizes the existing methods based on the Internet,investigate its influences thoroughly and makes the best of the both worlds.At last,the advantages and methods of the combination of the civil execution system and the Internet are refined,the further improvement of the scheme is proposed and the establishment of the relevant measures are carried out by summing up the existing measures.This paper is divided into four parts and the main contents are as follows:The first chapter mainly elaborates the concept of the civil execution system,summarizes the impact of the Internet on the civil execution,studies the various aspects of the dilemma,and then provides a specific direction for solving the problem of the civil execution.The second chapter mainly explores the civil enforcement measures carried out by the courts around the country and analyzes from three aspects and sums up its advantages and disadvantages,which includes the investigation and disclosure of the property of the person being executed,the linkage mechanism with the assisting enforcement departments,and the establishment of a unified civil execution command system.The third chapter mainly analyzes how to establish a civil execution of the mechanism of deterrence and improve the implementation of property control and disposal system.Through the Internet,the existing civil execution deterrencemechanism should be improved,and the hinder between the upper and lower links in the existing civil execution system should be opened up.The fourth chapter puts forward idea of measures about the reform of the civil execution system,including establishing a citizen network credit system through the Internet,associating the citizenship with their work and life,restricting thoroughly in the implementation,and strengthening the civil execution of deterrence mechanism to promote the performer consciously fulfills.
