Study On The Legislative Perfection Of Network Virtual Property

With the development of the internet industry in China,the importance of the network virtual property is increasingly prominent.The theoretical problems of the network virtual property in our country are different,such as whether the network virtual property belongs to the property,and how to define the nature of the network virtual property.Because of the lag of the law,there is still a blank in our legislation about the network virtual property.However,in the judicial practice,with the rapid popularization of the internet and the increasing number of the network virtual property disputes,the judges have different standards in dealing with the cases,and the different results of the same cases are very common.Therefore,it is necessary to improve the theory of the network virtual property,to clarify the legal nature of the network virtual property in legislation and to form a mechanism to solve the disputes of the network virtual property in judicial practice.This paper studies the network virtual property from the above three aspects,aiming at providing references and suggestions on the legislation of the network virtual property and the judicial work.The main part of this article is divided into four parts.The first part is the overview of the network virtual property,including the origin and development of the network virtual property,the definition and characteristics,and the discrimination of the similar concepts.The second part is the legal nature of the network virtual property,including the property negation,the theory of intellectual property,the theory of intangible property,and the theory of new property.The third part includes the legislative status and problems of the network virtual property.The fourth part is about improving the network virtual property legislation,including the legal nature of the network virtual property,the acquisition and demonstrative principle of the network virtual property,the legislation of the protection of the network virtual property,and the perfection of the legislation on the evaluation of the network virtual property.
