Qualitative Analysis Of Zhao's Case Of Issuing False Notarization

This article aims at perfecting the criminal responsibility of public servants.Via the analysis of Zhao's false notarization(Zhao,a notary from a notarial office in Shantou,has drawn up 3notarial certificates from 1995.1 to 1995.9,creating the loss of failing to calling the loan of 17,773,000 yuan of the bank).We analyzed from different aspects to discuss the loyal problems in this case,and the theoretical issues about criminal responsibility of public servant,such as totality and part,and theory and practice.This article is made up of 4 parts.The first part has introduced the Zhao's false notarization in detail,analyzed the main issues and trial situation,and led to the key topic of this article,namely the criminal characterization of false notarization which has made great economic loss.The second part has differentiated and analyzed the right of notary and the property of notarization institution via history and academic issues.The third part is the key part of this article,which has made theoretical analysis of the notary drawing up false notarization case's criminal charge and criminal structure,then differentiated and analyzed the application of charges,and discussed the responsibility property of notarial cases after reformation.The fourth part is the ending of the whole article,coming up with suggestions around the legislation,sectional management and supervisory mechanism of the notary's false notarization.
