Right Of Ratification In Unauthorized Agency

The right of ratification in unauthorized agency is an important right of the person in the theory of unauthorized agency,but it has not been concerned by the legal research in our country.The article 171 of the “General Provisions of the Civil Law” issued in 2017 follows the expression of Article 48 of “the Contract Law” and has not been further supplemented.The purpose of this thesis is to provide a method of hierarchical research for the analysis of the right of ratification in unauthorized agency.For this reason,this paper uses “manifestation of will” as the main line for the research on the right of ratification and it links the content of each chapter to a whole.By analyzing the content and motive of the ratification as the manifestation of will,and the making and arrival of it,and the change of the legal relationships of the principal,agent and counterpart after the expressing of it,we make a summary of the constitutive elements,the requirement of exercising and the effect of the ratification.Through the above analysis,this paper has constructed a hierarchical research approach to the research of the right of ratification in unauthorized agency,hoping that this article can provide some guidance for the further research on the right of ratification in the future.
