In the 21st century,population aging has become a global problem.According to the UN survey report(DESAPD,2010),the proportion of older people(over 60 years old)is increasing,which is accompanied by a decrease in the proportion of young people(under 15 years old);By 2050,the number of elderly people in the world will surpass that of young people for the first time in history.As one of the systems that actively deal with aging,the old-age welfare legal system has made great achievements in the fields of sociology and economics,but there are few studies in the field of jurisprudence.However,this system started relatively late in our country and has not yet formed a systematic legal system.It did not play its due role.This shows that there are still some problems in the old-age welfare system in our country.This article uses the comparative analysis method to compare the legal system of the elderly welfare in China and Japan,analyzes the similarities and differences of the system between the two countries,and on this basis,by combing the implementation of the old-age welfare system in our country,The status quo as an entry point,combined with China's national conditions and draw lessons from Japan at the same time,put forward corresponding countermeasures and suggestions.This article begins with the following four aspects:The first part systematically discusses the basic theory of the old-age welfare legal system,which will lay the foundation for the comparative analysis below.The second part compares the historical evolution of the legal system of old-age welfare in the two countries and explores the deep reasons why the two systems are different.The third part compares the similarities and differences between the two countries in population aging and the specific system.Based on the actual situation in our country,this part introduces the status quo and existing problems of the aged care in our country.Based on the comparatively perfect legal system of the aged welfare in Japan,the forth part puts forward the enlightenment suggestion on perfecting the elderly welfare system from some aspects.
