Family planning policy is a basic state policy of our country,which is the concrete measure of the country’s objective guidance on the quantity and quality of population birth in the field of population reproduction.In 2015,the fifth plenary session of the 18 th CPC central committee clearly put forward: Fully implement the policy of a couple having two children.The implementation of the "Universal two-child" policy has a positive significance in preventing China from falling into a low fertility trap,increasing the supply of labor resources,alleviating the aging population and balancing the gender structure of the population.But,the implementation of the new policy also has negative effects on women.In the conflict between female reproductive rights and the right of spouse reproduction,the gender discrimination faced by women in employment and the reproductive security of women are a series of problems that violate the legal rights and interests of women.Although China’s law gives a certain special protection to women in the disadvantaged position,due to the imperfect legal system and weak awareness of the rule of law,the infringement of women is endless.In particular,after the implementation of the "Universal Two-child" policy,employers’ discrimination against women’s employment is more prominent.Women,as the main responsible person for human reproduction and the indispensable human resources of the labor market,bear the burden of reproduction,family and work.How to balance the reproductive rights of women and employment rights,and improve the women’s employment protection and maternity protection system for the "Universal Two-child" policy of the smooth implementation play the important role.Based on the existing literature and the actual situation,this paper discusses the reproductive pressure and work pressure of female under the policy of "Universal Two-child".First of all,carries out the theoretical analysis of the female reproductive rights which combined with the implementation of the new policy.Then,focuses on the conflict of interest of reproductive rights and other rights and the forms of infringement and remedies of female reproductive right at the present stage.Finally,suggestions and measures are put forward on the protection of female reproductive rights under the policy of "Universal Two-child".
