Research On The Legal Issues Of The Reorganization Of State-owned Enterprises Under The Background Of China's New Normal

In present period,Reorganization of state-owned enterprises is not only an important part of the reform of state-owned enterprises,but also an important means of structural reform of the supply side of China's new normal context,by the relevant departments and the community attaches great importance to.However,due to the restructuring of the state-owned enterprises legal system is not mature,there are omissions in the content of legislation regulations and policy provisions are too general,resulting in the restructuring of state-owned enterprises lack of normative constraints,which are derived from the government administrative intervention is not appropriate,the reorganization supervision mechanism is not perfect,all parties to protect the rights and interests of incomplete legal issues.This paper argues that the legal regulation of the restructuring of the state-owned enterprises must firmly grasp the characteristics of the times,adapt to the new normal economic logic,government intervention in the restructuring of state-owned enterprises on the issue of government intervention should be stripped of the right,and take indirect intervention in the way of administrative intervention on the choice,not directly involved in the restructuring of state-owned enterprises;supervision the problems in the restructuring of state owned enterprises,the SASAC should be authorized to the rights of investors of state-owned capital operating companies and investment companies,to ensure that the SASAC become pure regulators,and the addition of legislative supervision,judicial supervision and social supervision in the restructuring of state-owned enterprises;in the protection of the legitimate rights and interests of stakeholders on the issue,should improve the small and medium-sized shareholders right to request to convene and supervise,implement the creditors in the restructuring of state-owned enterprises in the right to know and be right,construction workers labor relations internal co Business mechanism and compensation mechanism.Under the new normal,only the restructuring of state-owned enterprises into the legal track to regulate,can better achieve the value of state-owned assets,and promote the healthy and orderly development of state-owned economy and state-owned enterprises.
