Research On The Legal Application Of Bribery To Life Imprisonment

In August 29,2015,the Standing Committee of the Twelfth National People’s Congress passed the "People’s Republic of China criminal law amendment(nine)",which has been a common concern is:set up the "special major sentenced to death suspended for the crime of corruption and bribery,in its statutory sentence commuted to life imprisonment after may be life imprisonment without remission" this provision,parole.Prior to this,China has never been applied to life imprisonment penalty,the addition of the life imprisonment,not commutation,parole,means that the focus of large corrupt criminals will serve a lifetime until death in prison.According to the life imprisonment first appeared in the legislation,applicable to life imprisonment and will involve a lot of problems in the execution of punishment,and these are in judicial law in the course of new problems,it is necessary and significance of the study.The first part of the thesis makes a basic introduction to the emergence,historical development,current situation and future development of life imprisonment.And the life imprisonment and life imprisonment made a comparison,a positive answer to the difference between the two.Explores the value base of life imprisonment and its legal orientation,and determines that life imprisonment is only a special penalty execution measure,not a new type of punishment.The second part of the thesis focuses on the application of the time effectiveness of the new life imprisonment in China,and expounds how to better decide the application of life imprisonment in terms of time effectiveness.The second section focuses on the applicable object of life imprisonment.The third section focuses on the study of the amount of life imprisonment plus the application of the circumstances,so as to decide whether to apply.Finally,the case is better analyzed and compared with the application of life imprisonment.As life imprisonment in our country has just been added,the referee and the implementation will certainly have a lot of views and opinions,which is the current problem,and constantly improve its application is our future efforts.The last part of the thesis expounds the way out of the newly imposed life imprisonment in the implementation of the current penalty in our country,discusses the feasibility of life imprisonment and the impact of the amnesty system on life imprisonment.
