A Study On Legal Issues Of The Introduction Of Life Settlement Securitization To China

Life settlement securitization originated in the United States of the Viatical Settlement,and then developed into life settlement and life settlement securitization.In simple terms,life settlement securitization is a complex mechanism that combines life settlement as asset source and asset securitization,including settlement,asset transfer and securitization.This paper intends to study the legal issues of the introduction of life settlement securitization to China,in order to make some ideas and suggestions for the introduction of the system.The author mainly divides the thesis into four parts,and the details are as follows:The first part is about the overview of the life settlement securitization,and makes expositions mainly from the point of view of its operational mechanism,characteristics and concept.First of all,analyze its operating mechanism and characteristics according to the existing practice in the United States,followed by the introduction of domestic and foreign definitions,and give the author's definition after summary and analysis.The second part discusses the legal relationship of the life settlement securitization,mainly from the three aspects of its legal relationship content,subject and object.The author introduces the contents of the legal relationship in the form of text and structure,and discusses the subject and the object from the angle of legal theory.The third part discusses the legality of the introduction of life settlement securitization to China,which mainly includes the content involved in the aspects of insurance benefit principle,moral hazard,the object of securitization and bankruptcy segregation.Explain the legality through the demonstration that the life settlement securitization can meet the legal requirements above.The fourth part analyzes the feasibility of the introduction of life settlement securitization to our country.Firstly,it introduces the practical significance,demand and Pre-practice of the investment model.Secondly,it points out the problems of the introduction of life settlement securitization.Finally,the author puts forward some suggestions based on the previous discussions.The author carried out research and interpretation on the life settlement securitization from the legal point of view.On the one hand,we can have a more in-depth understanding about the investment model;on the other hand,it expresses the author's outlook of the introduction of the investment model to China,and the author hopes the unique charm and advantage of life settlement securitization can inject fresh blood into China's economic development.
