A Research On The Judicial Review Mode Of Chinese Death Penalty Cases

The death penalty review is the procedure followed by the Supreme People’s Court’s case review of cases sentenced to death,and it is the unique system of our country.The purpose of the death penalty review procedure is to correct the errors in the death penalty sentence and to more strictly control the application of the death penalty.The death penalty review procedure has been a long time in our country,but the question of the way of hearing the death penalty review process has not been paid by the legislator.The current written trial led to some problems for the death penalty review procedure such as the difficult of fact investigation,the difficult to protect defendant’s right,and the lack of legal supervision.This article mainly analyzes the problems existing in the procedure of the death penalty review procedure in our country,analysis the Current Situation of China’s Death Penalty Cases.Based on the theory of human rights protection and due process,and learn from the experience of the death penalty system and the protection of the rights in the United States to summed up feasible reform ideas for the completion of the death penalty review process and establish the relevant supporting system...
