Research On The Legitimacy Review Of Major Administrative Decision-making:

Administrative decision-making is the starting point of administration power operation.Wrong and illegal decision-making can cause great losses and dreadful impact.Administrative decision-making behavior should be standardized in accordance with the law from the origin in order to regulate and restrict administrative decision-making power effectively and foster administrative legalization level of the government.As a result,the aim of constructing a government ruled by law will be realized.It is significant to strengthen and improve major administrative decision-making procedure,which can push construction of democracy and rule of law,improve administrative efficiency and promote social harmony and stability.Legitimacy review on major administrative decision-making is the important guarantee of decision ruled by law.Administrative decision-making work is valued by our Party and nation.The 18th National Congress of the CPC,the Party of the second Plenary Session of the 18th CPC Central Committee and other plenary sessions have asserted explicit claim on decision ruled by law.In the long term,the Jiangsu government has attached great importance to legitimacy review on major administrative decision-making.However,in terms of practice,some problems exist,such as imbalance of regional development,mismatch of legislation level and regulation rigidity,inconsistence of decision-making cognition,imprecision of decision-making scope,incoordination of legitimacy review procedure and inefficiency of guarantee.These problems in Jiangsu are universal,typical,which will influence and restrict the process of national government ruled by law.Therefore,how to solve the specific problems about legitimacy review effectively has become an inevitable major project for various levels of government.This essay draws lessons from relevant practice of legitimacy review on major administrative decision-making of other province,focuses on the research of current situation and practice in Jiangsu in recent years,and summarizes main problems and causes so as to provide scientific and reasonable suggestions,which has theoretical and realistic significances.
