In the face of new forms of development in our country's economic and social fields,modern governance systems and governance capabilities are needed.To improve the modernization of the country's governance system and governance capabilities,we must use the rule of law as the cornerstone,and timely adjust unfavorable legal systems to better meet the requirements of economic and social governance.Internet rental bicycles are an innovative way of traveling in the area of urban transportation and are considered to be the typical format for sharing economic models.Since its inception,Internet-rental bicycles have made important contributions to urban mobility and have been widely recognized by the central government and social citizens.With the introduction of guidelines for the Internet rental bicycles by the Central Government and local governments,a preliminary system for the supervision of Internet leased bicycles has been established.However,due to the low legal level of the guidance,it is difficult for the relevant government supervision system to effectively solve the problems in practice.Through textual analysis and comparative analysis,the article takes the current state of government supervision as the starting point,and takes the legal issues existing in government supervision as the guide.It has made a comprehensive study of China's current Internet lease bicycle government supervision system.The first part of the article elaborates on the development of Internet rental bicycles and government supervision.Through the combing theory of the origin,characteristics and social values of Internet-rental bicycles,it is intended to illustrate that the new lease of bicycles on the Internet is not a short-lived product and has research value.Then,the basic theory of government supervision was briefly explained,which laid a theoretical foundation for the follow-up argumentation.The second part of the article analyzes and demonstrates the necessity of government supervision of Internet lease bicycles.From the perspective of the government's supervisory role in market behavior,the market failures in the Internet leasing bicycle market and the nature of the quasi-public goods owned by Internet-rented bicycles have determined that the government needs to be involved in supervision;from the perspective of other government supervision functions,there are The risks that jeopardize social public interests determine that the government needs to be involved in supervision;from the perspective of sharing economic models,sharing the characteristics of the economic model determines that the government needs to be involved in supervision.In the third part of the article,the specific behavior of the current government supervision of Internet lease bicycles is divided into two aspects.One is the issuance of regulatory documents and the other is the implementation of regulatory actions.On this basis,the legal issues that exist in the government supervision are put forward.Specifically,they are:First,there is a lack of regulatory laws and regulations,and the regulatory documents are of a low legal level,which cannot provide legal and regulatory evidence for the specific regulatory actions in practice;the second is supervision.The distribution of subject power is illegal and unreasonable,the allocation of power of supervision subjects is chaotic,and does not match with the power of list of powers;third,the supervision content is not perfect,and there is no supervision over outstanding issues;fourth,there is a lack of supervision and procedural rules,and there are gaps in supervision procedures;Fifth,there is a lack of consultation and cooperation rules between government agencies and platform companies.Existing regulations are relatively abstract and cannot be implemented in practice.The fourth part of the article is to improve the government supervision system for Internet rental bicycles.Based on the five legal issues that exist,propose corresponding suggestions for improvement.First,it should be formulated that the local government regulations provide the legal basis for government supervision.Second,the authority of the supervisory authority should be reasonably configured to combine the supervisory powers on the same issue and achieve centralized supervision and match with the distribution of power in the power list.Third,we should improve the content of government supervision from the realization of the legalization of the existing regulatory system and the establishment of a new regulatory system.Fourth,through the establishment of procedural rules of government supervision to ensure that the regulatory system is open and fair.Fifth,we should establish a platform for the supervision and management of Internet leased bicycles to achieve cooperation and governance among government agencies,platform companies,and the society.
