The Analysis On The Duty Crime Of The Heads Of The Governmental Departments At Departmental Level Since The 18th National Congress Of Chinese Communist Party

Corruption has become a serious issue affecting the steady development of China’s economy and society.Since the 18th National Congress of Chinese Communist Party,the central government has strengthened its anti-corruption efforts,of which the intensity and range have aroused widespread attention from both public opinion and the international community.As of May 2016,175 officials and military officers,who were above vice-ministerial level and corps level,respectively,have been arrested in China.While the "big tiger" triggered a heated debate in the society,the duty crime problem of the departmental level officials who are in middle of the national power structure has not attracted enough attention.The departmental level officials,who control a large volume of social resources,undertake the function of implementing specific national policies.Some heads of the governmental departments at the departmental level,due to their special positions,hold greater power and play a key role in the distribution of social resources,and thus have become the target to be"hunted" by various parties.Therefore,the research and analysis of duty crimes of these heads would to some extent deepen the implementation of China’s anti-corruption work,facilitate the efforts in preventing corruption,and promote the cultivation of the social incorruptible culture.This paper selected 37 duty crime cases in relation to the heads of the governmental departments at departmental level investigated by the procuratorial organ of a city since the 18th National Congress of Chinese Communist Party(from 2013 to June 2015)as its research subject;studied their basic features and rules through empirical analysis;summarized five features:corruption incubation period is long and half duty crimes are in relation to "corruption and promotion”;certain related persons are "accompanying all the way”and benefit transferring never ends;family corruption has become a serious issue;depraved lifestyle leads to corruption;duty crime of heads seriously affect "political ecology”.It also analyzed the reasons for duty crimes,including powers of the heads are over-concentrated;supervision measures on the exercise of power by the heads is insufficient;appraisal of the performance of the heads are one-sided and imbalanced;there is“demonstration”effect of duty crime of the heads;imperfect market mechanism causes the emergence of“group of corrupted friends and family”;and depraved thoughts are the subjective reason.It further proposed five suggestions:strengthening the efforts in fighting against bribery crimes and cultivating integrity and honest industry atmosphere;perfecting the cadre management system;establishing and improving the investigation and correction mechanism on the negligence in selecting and using peoples;strengthening the power supervision and control mechanism against heads;establishing and improving management system against families of heads.
