The Law-based Dimension Of Legislative Activities

The legislative activity is a practical activity that puts the concept of the rule of law into the legal provisions,which can be more intuitive and more rational to integrate the existing rule of law."Good law" and "good governance" are the important contents of the development of the rule of law,among which "good law" is the basis of the rule of law.Infiltration of the rule of law in legislative activities is a great progress in the construction of the rule of law.The 18 th national congress of the communist party of China(CPC)proposed to rule the country in a comprehensive way,and the party’s 19 major adherence to the rule of law will be an important part of the basic strategy of upholding and developing socialism with Chinese characteristics in the new era.With the development of the rule of law in China,legislative activities are paid more and more attention.With the continuous development of China’s economic culture,legislative activities have been adjusted accordingly,with a view to the internal unity of social effect,political effect and legal effect.In the backdrop of the rule of law,legislation is activity of legal workers join point contact with the masses of the people,and to achieve the ultimate goal of legislation,namely "realize everyone justice".Now due to various reasons,legislative activities caused the fast legislation and legislation,duplicated legislation status,so the rule of law of the construction of the obstacle,the need to constantly practice gradually optimized.In this paper,the author discusses how legislative activities can promote the construction of the rule of law from three aspects,including improving the quality of legislation,maintaining the dignity of legislation and establishing legislative authority.In order to build a force for the rule of law in our country,we should organize and sublimate the problems of promoting the rule of law by legislative activities.Overall architecture of this paper includes five parts,respectively is the introduction,the value of the basic relationship between legislation and the rule of law,legislation,the foundation of legislation and the rule of law is local,the improvement of the legislation activities under the rule of law perspective.The first part is the introduction.The introduction is divided into three parts: the background and significance of topic selection,research status and research methods and innovation points at home and abroad.Legislative activities are carried out in the context of the construction of the rule of law in China.In this article,combining with the current legislative situation in our country,draw lessons from foreign research experience,using comparative analysis,literature research and experience summary,through the analysis of the concrete construction of China’s legislative activities,and through the investigation and literature to comprehensive real control for research.The second part is to write the basic relationship between legislation and rule of law.Legislative activity is a prerequisite for the construction of the rule of law,and it is a practical demonstration of the rule of law in front of the people to promote the development of the rule of law.This paper starts with determining what is the legislative activity,then analyzes how the good law is defined,and the significance of the rule of law on legislation and the standard of good law.From the goal of the rule of law construction,the role of legislation in the construction of the rule of law is elaborated.The third part is the value of legislation.Firstly,the author puts forward that the value of legislation is the inherent requirement of the rule of law,and then discusses the two values of legislation.The value of legislative form includes operability,flexibility,stability and unity.The substantive value of legislation includes interest protection,national will,national compulsion and ethical value.Through the discussion of the two great values of legislation,it is necessary to pave the way for legislative activities.The fourth part is the foundation of legislation and the local rule of law.Starting from the concept of "local",this paper discusses the relationship between local and state,expounds the basis of local rule of law,and indicates the necessity of local legislation.Secondly,from the general situation of local legislation,this paper discusses the types and functions of local legislation,and then expounds on the legislation to deepen civil society,draw on excellent traditions,and combine national customs.The fifth part is the perfection of legislative activities under the perspective of rule of law.On the basis of analyzing the significance of legislative activities,it is clear that legislative activities should be carried out prudently.Secondly,by describing the characteristics of the law itself,it is necessary to determine the characteristics of the law itself and express the importance of deliberative legislation for the construction of the rule of law.Finally,through the three parts of legislation quality,legislation dignity and legislative authority to explore how to legislate carefully.
