Research On The Issue Of Disconnection Between Criminal Investigation And Criminal Technique

Criminal technique is an important investigation means for public security authorities to crack down criminal and illegal offenses according to laws,and trace evidences collected by criminal technical departments during investigation and expert opinions serve as important basis for the investigation and identification of crimes.However,there is disconnection between criminal investigation and criminal technique(hereinafter referred to as investigation and technique)in practices due to different systems and working mechanisms as well as other reasons.The fourth Plenary Session of the 18 th CPC Central Committee of Communist Party put forward the reform of "trial-centered litigation system”,bringing forward higher requirements on the enforcement of criminal laws and investigation by public security authorities,however,the disconnection between criminal investigation and criminal technique affects the quality and efficiency of the enforcement of criminal laws and investigation.Therefore,how to deal with the relationship between investigation and criminal techniques is particular important.The author is engaged in criminal technique work at the grass-roots practice department and therefore has deep understanding towards current issue of the disconnection between criminal investigation and criminal technique of public security authorities,and puts forward some specific measures through the analysis of causes behind the issue on the basis of the summary of the opinions of many experts and scholars in combination with some new changes in criminal investigation and criminal techniques.This paper is divided into the following four parts:The first part mainly introduces the purpose and significance of the research,the overview of criminal investigation and criminal technique,the relationship between criminal investigation and criminal technique,as well as basic meaning and contents of the integration of criminal investigation and criminal technique.The second part expounds major manifestations of the disconnection between criminal investigation and criminal techniques from different angles.The third part,based on the principle of internal and external factors in materialist dialectics,discusses the causes behind the disconnection between criminal investigation and criminal techniques from the perspective of external factors and internal factors.This paper analyzes the difficulties grassroots technical departments are faced with in investigation under current investigation system mainly from the aspects of imperfect working mechanism,unscientific examination mechanism and imperfect talent mechanism.The fourth part puts forward measures integrating criminal investigation and criminal techniques from the macro and micro point of view combined with current situation of public security authorities in China.The author proposes the reform of “integrating criminal investigation and criminal techniques,and separating investigation and identification”,and the implementation of new on-field investigation mechanism of “investigation,collection,recording and comparison under the leadership of director”,to classify and investigate cases level by level,improve the remuneration of police engaged in criminal techniques,change the ideas of police responsible for criminal investigation and criminal techniques,and strengthen their cooperation.
