It is inevitable to discuss the criminal misjudgment in criminal proceedings.In order to prevent and correct the misjudged criminal cases,the central government issued a series of policies,one of which is to establish the lifelong accountability system of quality for investigation and handling.The misjudged criminal cases may occur in every aspect of criminal proceedings.However,in recent years,the exposure of typical misjudged criminal cases shows the existence of a variety of illegal handling in investigation is the mainly reason for high incidence of criminal misjudgment.So it is imperative to carry out the lifelong accountability system of quality for handling and investigation.The lifelong accountability system of quality for handling and investigation refers to the meaning that the investigators within their duties take charge of cases of handling,identification,examination,approval by their own,and their quality regardless of changes of units,positions,rank or retirement.The system stems from early the accountability system of misjudged criminal cases drawing on the successful experience of the lifelong system of project quality,together with the back investigation system of wrong cases to build a strict,complete and efficient the accountability system of misjudged criminal cases.Compared with the the external response of misjudged criminal cases at home and abroad.study,we found that some countries with more perfect law like Britain and the United States do not advocate the implementation of the lifelong accountability system of quality for handling and investigation,but through the improvement of relevant laws,update the technical means of detection,and the establishment of the misjudged criminal cases mechanism which is instructive for China on the one hand and warns the difficulties and challenges of implementation of the lifelong accountability system of quality for handling and investigation on the other hand.For example: lack of a unified legal basis,low enthusiasm of the investigators,and difficulties to start.Therefore,in order to avoid wrong action to the executor due to accountability and the suppression of the law enforcement power,we must establish a clear and practical accountability system of misjudged criminal cases.At present,to build and improve the lifelong accountability system of quality for handling and investigation,we should seriously explore the following aspects: The applicable principles,the main body of responsibility,the wrong standard,the scope of responsibility,the time,the process and relief of the system to make sure a more scientific and practical system in the real situation.The criteria standards,the scope and the improvement of procedures play an important role in not expanding the power effectively and lowering the quality and effectiveness of handling.Besides,to keep smooth operation,measures should be taken in the improvement of the law enforcement and management system,supervision and management mechanism of law enforcement and handling,and the incentive mechanism to provide powerful guarantee and support for the implementation of the system.
