Research On The Problem Of Police's Victimization In Assaulting Police

As the transformation of social structure,system transition,interest adjustment and conceptual change constantly go deeper,China has been into an unprecedented period of social transformation since the 21 st century.New social contradictions are intertwined in the process,challenging the social order as well as people's life.As a new social phenomenon,the crime of assaulting police,in essence,is the external performance of clashes between police and people.Learning about the present situation and the harm of the crime of assaulting police,recognizing its causes and exploring a way to fix it in some deep aspects such as the law,system and the physical mechanism,are the current hot issues in the field of criminology.Using the principles that based on the domestic practice and draw experience from international practice,this article firstly summarizes the theory and the practice of assaulting police both at home and abroad in a comprehensive way,mainly involving criminal cases of assaulting police,the relevant laws,the police law enforcement capacity and so on.Besides,as analyzing the reason of assaulting police from the angle of the usage of forces in clashes between police and people is one of the innovations in this paper,the writer gets the whole picture of the latest researches of the police force at home and abroad.On this basis,the author in this article summarizes and analyses the crime of assaulting police's characteristics and types,and expounds the harm according to the data;moreover,based on the daily activity theory,the author builds the assaulting police interaction scenaria analysis pattern along the crime of the triangle path,combining the materials obtained from depth interviews,using the scientific software such as Nvivo and SPSS,analysing the reasons of the crime in 10 aspects from three dimensions:the offender,the victim and the scene;Third,he/she takes the problem as a starting point and puts forward specific measures to prevent the crime from the three aspects:the law regulation in view of the criminal,improving the law enforcement of the police and the police's personal security.The final conclusions are drew:the crime of assaulting police is the result of the joint action of the offender,the police,the scene and so on;in the crime scene composed of the above factors,the crime can be prevented by controlling one or several factors.
