Empirical Research On The Crime Of Infringement Of Citizens' Personal Information

In the era of information economy,citizens' personal information is with attribute of character and property.As widespread of application of network,the attribute of property of citizens' personal information is more and more distinguish.The gainful doers get profits by focusing on infringing of citizens' personal information which leads to the infringement of the safety and freedom of our national civil personal information.Base on 200 legal documents(totally 446 items)selected from China Judgements On Line,this article carried through case analysis and quantitative analysis with the help of SPSS software on the crime of infringement of citizens' personal information and found that the crimes of infringement of citizen's personal information having a trend of explosive growing and mainly happen in developed cities from east of our country.The doers commit crime in group.Their behaviors which are complicated and various often lead to crime committed by downstream person.The phenomenon of ‘ different judgment on the same case' happens because of the inconsistent identification on ‘gravity of the circumstances' from judge during the trail for these crimes.This article suggests to overcome the deficiency existed in the crime of infringement of citizens' personal information on the legislation level by editing ?judicial explanation? and?Personal information protection law?,and raises the connection between administrative execution and criminal justice for administrative execution and criminal justice optimization including building the complaint channel and supervision and punishment mechanism,case transfer mechanism,the judgement of competitive situation and involved Involved.
