Research On Post-Legislation Evaluation System Of Local Government Regulations In China

With the revision of the legislative law,the subject who can make the local government regulations is more diversified,and the contradiction between the expansion of the quantity and the quality of legislation is fierce.Post evaluation of local government regulations as a scientific mechanism to improve the quality of legislation has also been applied to practice.In recent years,the development of post evaluation of local government regulations have been proposed in some place in China.;there is no clear understanding about the evaluation purpose,evaluation subject,evaluation methods and means in its early stage,but now the evaluation subjects can work smoothly.Some local governments have also made assessment methods.Evaluation of the various elements and links is increasingly standardizedPost-evaluation of government regulations has made some achievement,but it started late and lacked of high-level specialized laws。In addition,the theory and practices of the post-evaluation of local government regulations is not rich.There are some differences in the evaluation subject,evaluation methods,evaluation criteria and evaluation procedure.Because the system is not perfect,which lead to the randomness of evaluation work and lack of operable.This paper consists of six part:The first part introduces the necessity of post-evaluation of government regulations in China.The second chapter introduces the basic theory of the post-evaluation system of local government regulations,including the conception and theoretical basis According to theoretical part to clarify what the system is.Then the article introduces some foreign situation of the post-evaluation of local government regulations,including American,Britain,European Union.Then the article introduces the present situation of post-Legislation evaluation of local government regulations in China,including the relevant practices of the areas of our country.In subsequent chapters is four suggestions to perfect the post-evaluation of local government regulations.Establishing a diversified evaluation subject which include makers,implementer,expert and so on is appropriate;Establish an evaluating index system to evaluate the efficiency of legislative quality;The third suggestion is that we can design a variety of evaluation methods;Perfecting procedure is the last part of this article.
