Empirical Analysis Of The Jury System

Jury system originated from western countries and was introduced into our country at the end of Qing Dynasty.The trial system in China has been developed fromanembryonic form for only a few decades.As a product ofclassstruggleand democratic politics,the jury system unexpectedlyexperiences "acclimatized" to the legal cultural tradition and the specific reality of our country in judicial practice.With the soar of economic and social of our country recently,the legal literacy of Chinese people have been greatly improved.As a result,people tend to settle disputes and safeguard their rights or interests through judicial proceedings.Meanwhile this trend require more for the jury system,which as an important part of judicatory in China now are facing many new challenges.Against this background,basedon the currentjudicialstatusand the features of the two major legal systems,anempirical research is employed to analyze the judicial implementation of some people's Courts in L District,R city,Shandong province in China.The purpose of this paper is to find out the shortcomings of the current people's assessor system in China and then put forward some countermeasures.Someadvicesaregivenasfollows: endow the jury system with corresponding constitutional status so as to better realize the citizen's right to participate in the trial;clearly stipulate and maintain the criteria for the selection of people's assessors;standardize the election methods of the people's assessors;promoting the reform of tiered management system for people's assessors;implement the financial guarantee;strengthen the responsibility and supervision;further refine the jury trial procedures;effectively guarantee the function of people's assessors in the trial activities to protect the people'srights.In the process of reforming and perfecting the people's assessor system in our country,there are still many difficulties to be solved.The realization of new breakthrough calls for the jointlycooperation for the two group of the academic circle and the judicial trial practice circles.
