The Study On Legal Regulation Of Internet Consumer Finance For College Students

The first college students internet staging set up in 2013 in China.Since that time,the industry of internet consumer finance for college students has experienced rapid growth.Electronic business platforms,commercial banks,P2 P network lending,consumption stages,consumer finance companies,etc.were engaged in internet consumer finance for college students.However,as a new industry,the legal regulation and government department supervision of internet consumer finance for college students is lagging behind,which led to development issues such as ethical issues,credit default,compliance issues,product quality problems,information security issues,unfair competition issues and the risk of civil and commercial law,criminal law,economic law and other areas of legal risk.Strengthening the legal regulation of internet consumer finance for college students is an important way to solve these problems effectively.However,in theory,the relevant academic research on internet consumer finance for college students is few.In practice,although regulatory authorities have developed a number of normative legal documents,there is still a lack of internet financial upper laws,department laws can not adapt to the internet finance development,lack of supervision or repeat jurisdiction and lack of third-party supervision system.This paper analyzes the problems and the major legal risks of this industry in China by discussing the nature and legal relationship of internet consumer finance for college students,and draws lessons from the measures taken to solve the related problems abroad.Finally,the author puts forward suggestions for the perfection of the legal regulation of internet consumer finance for college students in our country.This paper is divided into four parts: the first part is an overview of internet consumer finance for college students.First of all,the author introduces the environment and development course of internet consumer finance for college students,sums up the main mode of internet consumer finance for college students,analyzes the concept and legal relationship of internet consumer finance for college students from the perspective of providing consumer financial services for college students,and provides the concept and theoretical support for the research.The second part is the analysis of problems and the main legal risks faced byinternet consumer finance for college students.Due to lack legal regulation and departmental supervision,it leads to the problems such as low industry ethics,serious credit default,unlawful operation,poor quality of goods and unfair competition,thus the industry of the internet consumer finance for college students faces many legal risks in civil and commercial law,criminal law and economic law.The third part is the analysis of model of internet consumer finance for college students in foreign countries and the significance to the related industries in our country.Through analysis of the internet consumption financial model represented by SoFi platform in the United States,the design of legal system has important significance for the healthy development of related industries.The fourth part is the suggestion of perfecting the legal regulation of the internet consumer finance for college students.Through the above discussion,it is suggested that we should improve the Internet financial legal system,improve the industry supervision system,strengthen the construction of the self-discipline system of the industry,improve the financial protection of college students,learn legal supervision experience of internet consumer finance for college students from foreign and promote the legal propaganda,education and public opinion.
